Response
The Scottish Police Authority has considered your request under the Freedom of Information (Scotland) Act (FOISA).
In response to questions one and two of your request, the Authority does not hold this information under explanation that disciplinary/misconduct hearings for non-senior officer ranks are a matter for Police Scotland in terms of the Police Service of Scotland (Conduct) Regulations 2014.
In response to question three of your request, the SPA has received a total of three appeals to Police Appeals Tribunals stemming from misconduct hearings chaired by then Chief Superintendent Catriona Paton which resulted in the individual in question being dismissed from Police Scotland for gross misconduct.
In response to question four of your request, two of the three appeals in question have been determined by Police Appeals Tribunals – both of those appeals were upheld, with the Police Appeals Tribunals instructing the Chief Constable to reinstate the appellants. The third appeal is still ongoing.
