Issued 17 July 2023, this FOI response provides information on storage of samples collected from a crime scene and advises that the Defence Access Policy is publicly available - this ensures that defence agents and independent forensic science experts have consistent, fair and transparent access to productions.


Request

I am interested in finding out how long Scottish Police Authority are required to store samples taken from a Crime Scene that have not yet been tested but may contain DNA, if a person has been convicted of the crime but is claiming their innocence?

I am also interested in finding out if the convicted person’s legal representative is able to request and obtain any untested samples to be tested at a laboratory of their choice?
